Think Outside (the boob) Breast Cancer Recovery Program products, activities, and practices, and all persons involved in the creation and leading of the program products, activities, and practices (hereinafter referred to as "AGENTS") act only in their capacity as AGENTS for the participant in all matters connected with travel, sight-seeing journeys, practices in nature, exposure to nature and transportation, and as AGENTS hold themselves free of responsibility for any damage occasioned by any cause.
AGENTS will not be responsible for loss or damage to any of the participant's belongings. AGENTS shall not be responsible for personal injury, death, accident, delay, loss, damage, irregularity, or property damage as a result of force majeure or any other losses or damages incurred by any person or journey participants caused by any delay or change of itinerary or arising out of any act, including, but not limited to, any act of negligence, any person acting for or on behalf of AGENTS for transportation, accommodation or sight-seeing provider or any other person or entity rendering any of these services or accommodations being offered in connection with this journey.
This agreement supersedes all previous oral or written communications, representations, or agreements between the parties. Participants assume the risk involved when participating in yoga, meditation, exercising, and therapeutic nature practices and activities (see definition of activities in Definitions section). Participants agree that any and all disputes between Participants and Think Outside (the boob) shall be governed by California law.
Participants agree to mediate any and all disputes before the institution of any litigation. In the event of any litigation between the Parties to this agreement involving their respective rights or obligations, such litigation shall take place in Alameda County, California and the prevailing party shall be entitled to recovery of reasonable attorney’s fees and court costs of litigation. AGENTS will provide safe, careful instruction, but ask that each participant take personal responsibility for their own medical, health, and self-care and (in the unlikely case) for any injuries incurred during the practice of this program. If participants are unsure of their mental or physical ability due to previous injuries or medical treatments and procedures, they should seek the advice of a healthcare practitioner beforehand.
By participating in any online program of Think Outside (the boob), including but not limited to activities, adventures, fundraisers, and podcasts, you agree that you do so at your own risk, are voluntarily participating in these activities, assume all risk of injury to yourself, and agree to release Think Outside (the boob) from any and all claims or causes of action, known or unknown, arising out of Think Outside (the boob)’s negligence. Please consult with your physician and health care team before beginning any health and wellness program.
By choosing to participate in the Think Outside (the boob) Breast Cancer Recovery Program, or use the online newsletters, Adventure Guides, podcasts, blogs, or fundraisers found on this Site, you agree to the following:
• Breast cancer recovery is an individual experience. You will progress at your own pace, and if you experience any pain or discomfort, you will listen to your body, adjust the practice or activity, and/or stop and rest when needed.
• You understand there is an inherent risk associated with any health and wellness program including your voluntary participation in breast cancer recovery practices, activities, and adventures that may result in injury. You understand and are aware that the components of these practices are potentially hazardous activities and may cause injury.
• You acknowledge that you have either 1.) had a physical examination and/or have been given permission from your physician to participate in a breast cancer recovery or breast cancer survivorship program or activities or 2.) that you have decided to participate in a breast cancer recovery or breast cancer survivorship program voluntarily and without the approval of your physician and do hereby assume all responsibility for your participation in the breast cancer recovery program, practices, online activities or any other activity associated with Think Outside (the boob).
• You, your heirs, and legal representatives do hereby forever waive and release Think Outside (the boob), its members, teachers, facilitators, coaches, mentors, agents, volunteers, and employees from any and all liability and responsibility from injury, accident, illness, legal and medical fees sustained now or in the future resulting from your participation in any Think Outside (the boob) practices, adventures or activities.
• Any recommendations or advice given in the program regarding breast cancer recovery, exercise, activities, nutrition, medical information, physical, mental, spiritual, social-emotional health, or nature and health are based on extensive research and experience and are not considered medical advice.
• You understand that Think Outside (the boob) is not a licensed medical or health care provider and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise or practice on a medical condition.
“Activities” include, but are not limited to the following activities which may be recommended, provided, and/or sponsored by Think Outside (the boob) and its programs, fundraisers, blog posts, newsletters, or podcasts: yoga, hiking, golfing, walking, swimming, wine tasting excursions, paddling, rowing, transportation, training, classes, instruction, traveling to and from destinations, and any and all other activities and/or pursuits voluntarily undertaken while participating in Think Outside (the boob) and its websites, programs, blog posts, newsletters, podcasts, and fundraisers.
“Risks” include, but are not limited to those known risks inherent to the Activities specifically listed below, vehicular travel and traffic, road and trail conditions, known and unknown health conditions or medical emergencies, allergies, sudden weather changes, rain, tides/currents, wind, hail, lightning, earthquakes, wildfires, high altitude or motion sickness, dehydration, heat stroke, snake bite, bee, and other insect stings and/or bites, wild and domestic animals, swimming, tripping or falling, inaccessibility to immediate medical attention, falling rocks, and trees, equipment failure, driver error, rider error, Participant error, food provided, facilities, actions of other people, and acts of God.
Risks inherent in Think Outside (the boob) activities are dangers or conditions that are an integral part of yoga, hiking, or nature activities, including but not limited to minor muscle strains, muscle sprains, bruises, abrasions, post-exercise muscle soreness, joint injuries, torn muscles, heat-related illnesses, broken bones, ACL injuries, back injuries, stroke, heart attack, paralysis, death, and injury or death caused by any of the following: equipment that breaks or otherwise fails, slips and falls, lack of nutrition or hydration, negligence on the part of Participant or other people around Participant, terrain, facilities, temperature, weather, earthquakes, condition, equipment, wildlife, actions of other people including, but not limited to, participants, volunteers, spectators, and teachers.

Think Outside (the boob) Breast Cancer Recovery participants are guaranteed lifetime access to the Think Outside (the boob) Breast Cancer Recovery Program Facebook group, lifetime access to mentoring done inside the Facebook group, and lifetime access to the program content. Think Outside (the boob) Breast Cancer Recovery Program and the Think Outside (the boob) Breast Cancer Recovery Program Facebook group is available to you for as long as it exists.
The Think Outside (the boob) Breast Cancer Recovery Program Enrollment Guarantee If within the first 30 days of enrolling, you don’t feel like the Program is for you for whatever reason, send us an email and attach your fully completed worksheets for the first 2 modules of The Think Outside (the boob) Breast Cancer Recovery Program and we’ll send you a prompt refund.
All refund policies are stated clearly on the sales page and check-out pages before the product purchase.
If you are within the allotted time to request a refund, the Think Outside (the boob) support team will reply to your email to discuss the next steps to process the transaction.
A request for refund or cancellation is possible within the first 30 days after purchase only. To obtain a refund or cancellation within 30 days, the completed worksheets from the first 2 modules of the program must be sent to cnelson@thinkoutsidetheboob.com along with your refund or cancellation request. No refund or cancellation will be provided unless the work from the first 2 modules is sent in.
After 30 days of access is up, NO refund or cancellation will be provided. If you signed up for the 3-month payment plan on the full version of the Think Outside (the boob) Breast Cancer Recovery Program, rather than paying in full, all payments are required on the total program cost.
Past due accounts are sent to external collections after 75 days of non-payment. This program is not a subscription or month-to-month program where payments can be canceled after signing up.
We are not able to make exceptions above and beyond the terms and conditions of our specific refund policies. If you are outside of the specified refund date or have not met the criteria that will make you eligible for a refund, your request will not be approved.
Refund requests and approved refunds will be processed on the 15th and the 30th of each month.
There is 24-hour call cancellation, call rescheduling, and no-show policy. The client must give 24 hours’ notice regarding the cancellation or rescheduling of a call. If a call is canceled or rescheduled within those 24 hours, the client will be given a one-time grace period of 7 days to reschedule each call. After that, calls will not be rescheduled any further.
Life happens. You will be notified if a payment has been declined. Upon notification, you will have 5 business days to update payment info or contact Think Outside (the boob) to make alternative payment arrangements. If payment information or arrangements are not updated within those 5 business days, you will be withdrawn from the program until the account is brought up to date.
If you are currently on a payment plan for a program purchased, please note that we are not able to pause or suspend payments unless in cases of extenuating circumstances that must be approved.
If your request is approved, payments can only pause for one month maximum. If your request is not approved, you are responsible for making all required payments on time as per your payment agreement upon purchase.
